JOYFL MUSIC (“JOYFL,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains what personal information we collect, how we use it, and the choices you have. It applies to our websites, mobile apps, and services that link to this Policy (collectively, the “Services”).

When no longer needed, we will delete or de-identify data. If you delete your account, we generally remove or de-identify your personal data within a reasonable period, but may retain limited records (e.g., fraud prevention, tax, DMCA, financial records).

Depending on your location, you may have rights to access, correct, delete, port, or restrict/opt-out of certain processing (including targeted advertising), and to appeal our decisions. See Sections 13–14 for Colorado/California/EEA/UK details. We will verify your request and respond within the timeframe required by applicable law.

We use administrative, technical, and physical safeguards to protect information, including encryption in transit, access controls, and monitoring. No method is 100% secure; please use a strong, unique password and keep it confidential. Report concerns to contact@sonofdavid.music.

We may process and store information in the U.S. and other countries. Where required, we use appropriate safeguards (e.g., Standard Contractual Clauses) for cross-border transfers.

The Services may link to third-party sites or include third-party SDKs. Their privacy practices govern their handling of your data. Review their policies.


13) U.S. State notices (Colorado, California, and others)

Right to opt-out of targeted advertising and certain sharing: You can direct JOYFL not to process your personal information for targeted advertising or to “share” for cross-context behavioral advertising by adjusting Account → Privacy or emailing contact@sonofdavid.music. We also process GPC/recognized opt-out signals where required.

Other rights: Access, correction, deletion, portability, and right to appeal a denial.

California: We do not sell personal information for money and do not collect “sensitive personal information” for the purpose of inferring characteristics. We disclose categories of information as described in Sections 2 and 6 for business purposes. Shine-the-Light requests may be sent to contact@sonofdavid.music.

Transfers: We rely on Standard Contractual Clauses and comparable safeguards for transfers to countries without an adequacy decision.

We may update this Policy. We will post the updated version with a new “Last updated” date and, if changes are material, provide additional notice. Your continued use of the Services means you accept the updated Policy.

JOYFL MUSIC — Terms of Use

These Terms of Use (“Terms”) are a legal agreement between you and JOYFL MUSIC (“JOYFL,” “we,” “us,” “our”) governing your use of our Services (websites, apps, and any products, features, or content we offer). By accessing or using the Services, you agree to these Terms.

If you use JOYFL as a creator (uploading/distributing content), these Terms include the Creator Terms (Section 6) and the DMCA/Takedown Policy (Section 15).

Subject to these Terms, JOYFL grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial streaming and lawful purposes. We and our licensors retain all rights to the Services, including software, interfaces, and content we or our partners provide.


4) Your content and conduct (listeners)

You may create playlists, post comments, send messages, and otherwise interact where features permit. You agree that you will not:

5) Third-party links and services

JOYFL may include third-party content, SDKs, or links. We are not responsible for third-party services’ content or policies.


6) Creator Terms (uploads, distribution, and monetization)

If you upload or distribute audio or other content (“Creator Content”):

  1. Rights & Clearances. You represent and warrant that you own or control all necessary rights (including masters, compositions, samples, artwork, and metadata), and that your uploads do not infringe any third-party rights or violate law, contracts, or moral rights.
  2. License to JOYFL. You grant JOYFL a worldwide, non-exclusive, royalty-free (unless otherwise agreed in a separate monetization agreement), sublicensable license to host, store, reproduce, transmit, adapt (e.g., transcode, normalize loudness), publicly perform, display, and make your Creator Content available on and through the Services, and to use associated names, trademarks, and artwork to operate, promote, and improve the Services. You can delete your uploads; reasonable caching/backups and prior shares may persist.
  3. Content ID & Moderation. You authorize JOYFL to use fingerprinting and other tools to detect duplicates, enforce territorial/rights restrictions, and manage takedowns/disputes.
  4. Royalties/Payments. If JOYFL offers creator monetization, additional terms (rate cards, reporting, payment schedules, tax forms, and fraud checks) will apply and are incorporated by reference.
  5. Moral rights. To the extent permitted by law, you waive or agree not to assert moral rights against JOYFL for purposes of operating the Services (we will not make derogatory modifications).

7) User feedback

If you send ideas or suggestions, you grant JOYFL a perpetual, worldwide, irrevocable, royalty-free license to use them without restriction or compensation.

You agree not to misuse the Services, including by:

9) Ownership; no transfer

Except for the limited licenses granted in these Terms, no rights are transferred to you. Creators retain ownership of their Creator Content, subject to the license in Section 6.


10) Privacy

Our Privacy Policy (above) explains how we collect and use personal information and is incorporated into these Terms.


11) Termination

You may stop using the Services at any time. We may suspend or terminate access immediately if you materially breach these Terms, pose risk, or where required by law. Upon termination, your license ends, but Sections meant to survive (e.g., disclaimers, limitations, arbitration, IP grants as needed for prior use) will continue.


12) Disclaimers

The Services and all content are provided “as is” and “as available.” To the fullest extent permitted by law, JOYFL disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and does not guarantee uninterrupted or error-free service.


13) Limitation of liability

To the maximum extent permitted by law, JOYFL and its affiliates, officers, employees, and agents are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits or revenues, arising from or related to your use of the Services. Our aggregate liability for any claim will not exceed the greater of $100 or the amounts you paid to JOYFL in the 12 months before the claim. Some jurisdictions do not allow certain limitations—those limits apply only to the extent permitted.


14) Indemnity

You will indemnify and hold JOYFL harmless from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your Creator Content, or your misuse of the Services.


15) Copyright policy; DMCA takedowns

JOYFL respects intellectual property. If you believe content infringes your copyright, send a DMCA notice to:

Your notice must include: (a) your physical/electronic signature; (b) identification of the copyrighted work; (c) identification of the allegedly infringing material and its location; (d) your contact information; (e) a statement of good-faith belief; and (f) a statement under penalty of perjury that your notice is accurate and you are authorized to act. We may remove or disable access to allegedly infringing content and, where appropriate, terminate repeat infringers.

If your content was removed, you may submit a counter-notification meeting DMCA requirements.


16) Changes to the Services or Terms

We may modify the Services or these Terms. If we make material changes, we will provide notice (e.g., in-app, email, or by posting). Continued use after the effective date constitutes acceptance.


17) Governing law; dispute resolution

These Terms are governed by the laws of the State of Utah (USA), without regard to its conflict-of-laws rules.

Informal resolution. Contact contact@sonofdavid.music first; most issues resolve quickly.

Arbitration (U.S. users): Except for small-claims court or injunctive relief for IP/security, any dispute will be resolved by binding arbitration on an individual basis under the JAMS Rules. No class actions. Venue: Salt Lake County, Utah, unless the arbitrator permits remote proceedings. This clause is intended to be enforceable to the fullest extent permitted by law. If unenforceable, disputes will be resolved in the state or federal courts in Salt Lake County, Utah, and you consent to jurisdiction there.

EEA/UK users retain any non-waivable forum rights under local law.
